1. In a May 17, 2024 BT article titled “BU” with the subtitle “BV,” it was reported that G had been encouraged by D to engage in album push-selling. G stated that although D suggested they could break an initial sales record with CJ album distribution and recommended pushing 100,000 copies, G firmly refused because it went against F’s business philosophy.

“Although this is an issue already known within D, we once again request that you thoroughly investigate whether there were transactions with subsidiaries under return conditions or any transactions that could appear to be album push-selling, and handle the matter transparently and strictly.”


2. ① There appear to be indications that defendant company’s CEO V recommended that F push G’s albums. On August 4, 2023, D’s head of financial planning team also used the term “bulk push-selling,” suggesting there were internal signs within D that could raise suspicion of push-selling.

② After plaintiff A raised the issue, D stated that in 2023, two albums were each sold in a structure allowing returns of 70,000 copies, totaling 140,000 copies, and testified that they strengthened internal controls and enacted company regulations to prevent recurrence.

24) In a KakaoTalk message, B said:

“I heard it seems like D transferred inventory in the reorganization?”

A responded that V once mentioned the possibility of pushing inventory to Japan (to them), suggesting that since Korean albums are bought in Japan, encouraging more purchases could be an option. A stated they refused.

A further stated that after hearing from CJ that album sales in Japan were not as strong as expected, V appeared concerned about this. However, A also admitted during questioning that “the part about ‘selling by any means necessary’ was mostly a joke.” (page 134)

25) On August 4, 2023, D’s financial planning team leader BW responded via Slack:

“When directly asked about BX: since BX bears the largest share of D’s profit and inventory burden / marketing & promotion costs borne by BX / if BX handles distribution, D’s profit decreases and bulk push-selling becomes impossible and inventory/marketing costs shift to the label.” (page 348)

For reference, we have also included the history of transactions under return conditions, as well as completed projects. … Projects scheduled for returns and (line initialization) are not yet reflected and are volumes additionally undertaken by BX due to inventory burden.
